[摘 要] 目的 探索医疗损害案件违法行为的认定与行政处罚；方法 通过合理运用医疗专业知识及卫生法律法规对医疗损害案件中违法行为的认定与行政处罚，探讨对此类违法行为的处置办法。结果 成功完成了对医疗损害案件中违法行为的行政处罚。结论 对医疗损害案件中违法行为的可以予以行政处罚，并为今后正确处理类似案件提供经验和借鉴。
