[摘要] 健康权是新型的社会权利，对健康权的保护体现了一国对人权的保护程度。目前，我国正在加强立法以对健康权形成周密的保护。保护健康权的立法质量究竟如何，可以从纵向上的保护体系完整度和横向上的保护周全度的形式指标，以及从卫生资源的公平分配、健康权的事前保障度和事后救济的实质评价指标进行客观评价，并指导将来的立法工作。
